Terms of Service

These Terms of Service (“Terms”) govern your access to and use of peptiva.bio and any products, services, or content offered through the Site (collectively, the “Services”). By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old (or 21+ where required by your local law) and a qualified researcher, scientific professional, or otherwise lawfully entitled to purchase research-use chemicals to use the Site. You must also be legally authorized to enter into binding contracts in your jurisdiction.

By using the Site you represent and warrant that you meet these eligibility requirements.

2. Research use only

All products sold on peptiva.bio are research chemicals intended strictly for in-vitro laboratory research. They are not drugs, dietary supplements, cosmetics, food, or medical devices. They are not approved by the U.S. Food and Drug Administration (FDA) or any equivalent authority for human or veterinary use.

You agree:

  • You will not consume, ingest, inject, inhale, apply topically, or otherwise administer any product to any human or animal.
  • You will not resell or transfer any product to any person or entity that intends to use it for human or veterinary consumption.
  • You will handle all products in accordance with proper laboratory procedures, including appropriate personal protective equipment and disposal protocols.
  • You assume full responsibility for compliance with all federal, state, and local laws applicable to your possession, handling, storage, and disposal of these compounds.

3. No therapeutic, diagnostic, or medical claims

Peptiva makes no claims, express or implied, that any product on the Site can be used to treat, cure, prevent, mitigate, or diagnose any disease or condition in humans or animals. Any reference to research findings is provided for informational purposes about laboratory studies only and is not a recommendation, indication, or instruction for any non-research use.

4. Account responsibilities

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your username and password.
  • All activity that occurs under your account.
  • Providing accurate, current, and complete information at registration and keeping it up to date.

You agree to notify us immediately of any unauthorized account use at support@peptiva.bio.

5. Orders, pricing, and payment

  • Prices are listed in U.S. Dollars and are subject to change without notice. The price applied to your order is the price displayed at the time you complete checkout.
  • We reserve the right to refuse or cancel any order, including for reasons such as suspected fraud, ineligibility under Section 1, suspected non-research intent, pricing errors, or compound availability.
  • Payment is due at the time of order. By submitting payment information you authorize us (and our payment processor) to charge the full order amount to your selected payment method.
  • You are responsible for all applicable taxes, duties, and fees.

6. Shipping and risk of loss

Shipping is governed by our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for carrier delays, customs detentions, or events outside our reasonable control.

7. Returns and refunds

Returns and refunds are governed by our Refund Policy. By placing an order you acknowledge and accept the terms of that policy.

8. Intellectual property

All Site content — including text, images, graphics, logos, product names, and the “Peptiva” brand — is the property of Peptiva Bio or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

9. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Site, our servers, or any related systems.
  • Interfere with or disrupt the operation of the Site (including by introducing viruses, malware, or denial-of-service traffic).
  • Scrape, harvest, or collect data from the Site by automated means without our written permission.
  • Misrepresent your identity, eligibility, or affiliation.

10. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PEPTIVA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PEPTIVA DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY PRODUCT IS FIT FOR A PARTICULAR USE BEYOND ITS LABELED RESEARCH SPECIFICATIONS.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PEPTIVA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SITE OR ANY PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PEPTIVA’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

12. Indemnification

You agree to indemnify, defend, and hold harmless Peptiva, its officers, directors, employees, and affiliates from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of (a) your breach of these Terms, (b) your use or misuse of any product (including any administration to a human or animal in violation of Section 2), or (c) your violation of any law or third-party right.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Virginia Beach, Virginia, and you consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. The “Effective date” at the top reflects the latest revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
